That's a bunch of bullshit. As any person familiar with that type of gun will affirm. That gun will not fire unless the hammer is cocked. Then, "who cocked the hammer may be the relevant question" The scene required a draw. That gun is not carried with the hammer cocked. The only way it could have fired is if it was drawn and then cocked.

He says he pulled the hammer partially back and then let it back down and the gun fired. Three points: 1) if the hammer is pulled back past half cock it cannot be released unless the trigger is pulled. 2) if he didn't pull it back far enough to half-cock it and then his thumb "slipped" I don't think there's enough force to ignite a primer. 3) he's still responsible for where the muzzle was pointed.

Was the gun an original or was it a repro? If it's a repro I'll bet it's got a hammer block. The firing pin can't strike the primer unless the trigger is pulled.

In any case, he's a lying crybaby trying to get out of any responsibility.
